Understanding and Obtaining U.S. Employment Visas

There are a variety of employment visas in the united states. Simply put, there are immigrant visas and non-immigrant visas. An immigrant visa is for individuals seeking permanent residency, while non-immigrant visas are for individuals going for a short stay. In this article, we are going to focus on non-immigrant visas.

Non-Immigrant Visa

This visa is ordinary for foreign employees. Prospective employers need to sponsor their applicants by applying for a “proof of right to work in the united states” permit with the U.S. Citizenship and Immigration Services. They may also request the Department of Labor’s approval on behalf of the employee. This is to show that the employee will not go against any employment law of the united states.

Visas are issued according to your job, nationality, or how you relate with the employer. The employer must also confirm your employment before receiving your employment visa. They do so by contacting the department of labor for labor certification approval.  Your prospective employer will then visit the U.S. Citizenship and Immigration Services(USCIS) to file an immigrant “petition for alien worker” form. You will fill in the employment eligibility verification details.

Upon approval, USCIS will forward your petition to the National Visa Center, where they will require your details including, civil documents, job application forms, among others. The NVC will then schedule an interview with the embassy to interview you for a visa. You will also have a medical examination and get the necessary vaccines for you to travel to the united states.

U.S. embassy will then tell you how long you will have to wait to receive your visa. Make sure you give out the right information for quick processing. Once you receive your visa, you are free to travel to the united states within the set time.

Since these visas are numerous, employees will be issued depending on the work eligibility and duration. Once in the united states, you will live an everyday life just like permanent residents.
